SMSF loans and loans to trusts

SMSF loans let you buy residential or commercial investment property through your SMSF. The property must be an investment, rather than for personal use, although your business can lease a commercial property from your SMSF.

While the paperwork for SMSF loans and trust loans is more complex than for a standard loan, in the right circumstances these loans can improve your financial position significantly. What property can you buy with an SMSF loan?

Superannuation funds, including SMSFs, are heavily regulated and are required to invest solely for the purpose of growing retirement savings. This leads to restrictions on the amount and kinds of property that you can purchase using an SMSF loan.

You can only purchase one property via your SMSF. As already noted, the property must meet requirements as a suitable investment. In addition, it cannot be property which a trustee or related party owns or has owned.

Most SMSF loans are for a residential investment property or for a commercial premises which is leased back to your business.

How are SMSF loans different from normal home loans?

Technically, SMSF loans are ‘limited recourse borrowing arrangements’ (LBRAs). This is to protect the other assets in your super fund. It’s also what causes some of the extra paperwork!

Overall, your loan will look like a standard property loan, but fees, rates and the deposit required tend to be higher. Features such as offset accounts and the ability to redraw funds are rare, and SMSF loans may be difficult to change or amend. Getting the detail right is always important, but for SMSF loans it’s even more important to be right first time.
